eSignature legality summary
As a general rule, a contract signed manually, electronically, or digitally is enforceable in court provided the parties’ willingness can be proven and the law requires no additional formality.
Types of permitted electronic signature
Peru recognizes three tiers: a general Electronic Signature (any electronic symbol used to authenticate or bind, fulfilling some functions of a handwritten signature); a Digital Signature (asymmetric cryptography); and a DSOESI — a digital signature generated within the Official Electronic Signature Infrastructure using a certificate from an INDECOPI-accredited provider. A DSOESI has the same validity as a handwritten signature plus a non-repudiation presumption.
Documents that may be signed electronically
Many categories may use any electronic signature — procurement, corporate resolutions, NDAs, healthcare, banking, lending, education, life sciences, technology, recordable documents, and consumer transactions.
Use with caution / not typically appropriate
Use care with agreements that must be registered before a public registry to bind third parties, documents requiring notarization, and HR documents. If a non-DSOESI signature is challenged, the relying party may need to prove validity (authentication, consent, tamper-evidence, audit log).
